Closing an Estate in Virginia

Before an estate is properly completed or closed in the commonwealth of Virginia, the Commissioner of Accounts must be certain that you have satisfied all of the requirements and obligations. This means that all creditor claims against the estate must be settled or dismissed, estate taxes must be paid, and the remaining assets must be distributed to the beneficiaries. In order for the Commissioner of Accounts to allow an estate to be closed, the personal representative must produce a Final Account of the estate.

The Final Account must show:

  • All assets have been distributed to the beneficiaries and the balance of the account is zero
  • The distribution of the assets to the beneficiaries was in conformance with the will. If there was no will, the distribution must have been made in accordance with Virginia law.

If all conditions have been satisfied, the Commissioner of Accounts will allow the estate to be closed.
